Certain applicants who are seeking to renew their Employment Authorization Document (EAD) now qualify for an automatic 180-day extension of employment authorization while their Form I-765 renewal application is pending. This of course assumes that the renewal application was timely filed prior to the expiration of the previous EAD.
This policy covers certain noncitizens who are granted employment authorization incident to their status or circumstance, such as refugees, asylees, and TPS. It also covers certain noncitizens who must affirmatively apply for employment authorization, such as applicants for asylum, adjustment of status, and withholding of removal. Notably, this policy also covers EAD renewals for H-4, E, and L-2 applicants.
