Employment-based
USCIS will accept employment-based Adjustment of Status filings in the month of November 2023 using the USDOS’s Dates of Filing table as published in the November 2023 Visa Bulletin.
For EB-2 cases with a priority date prior to 01 Jan 2023, adjustment of status applications may be filed starting 11/01/2023, except for nationals of India whose priority date must be prior to 15 May 2012, and of China whose priority date must be prior to 01 Jan 2020.
For EB-3 cases with a priority date prior to 01 Feb 2023, adjustment of status applications may be filed starting 11/01/2023, except for nationals of India whose priority date must be prior to 01 Aug 2012, nationals of China whose priority date must be prior to 01 Sep 2020, and of the Philippines whose priority date must be prior to 01Jan2023.
For those who have employment-based AOS applications pending and are awaiting eligibility for final processing, or who will be processed for employment-based immigrant visas abroad, the Final Action Dates table shows very little movement from October to November 2023. EB-2 India is at 01/01/2012; EB-2 China is at 10/01/2019; while the Rest of World (EB-ROW) is at 07/15/2022.
Family-based
Similarly, for family-based Adjustment of Status filings in the month of November 2023, the USCIS will use the USDOS’s Dates of Filing table from the November 2023 Visa Bulletin.
FB-1 dates are 01 Sep 2017, except for Mexico whose date is 01 Apr 2005, and the Philippines whose date is 22 Apr 2015.
FB-2A dates are 01 Sep 2023 for the entire world.
FB-2B dates are 01 Jan 2017, except for Mexico whose date is 01 Aug 2004, and the Philippines whose date is 01 Oct 2013.
FB-3 dates are 01 Mar 2010, except for Mexico whose date is 15 Jun 2001, and the Philippines whose date is 08 Nov 2003.
FB-4 dates are 01 Mar 2008, except for India whose date is 22 Feb 2006, Mexico whose date is 15 Apr 2001, and the Philippines whose date is 22 Apr 2004.
For those who have family-based AOS applications pending and are awaiting eligibility for final processing, or who, more probably are waiting to be processed for family-based immigrant visas abroad, the Final Action Dates table shows almost zero movement from October to November 2023, with the exception of four out of five categories for Mexican nationals. FB-1 Mexico moved a couple of weeks to 01 May 2001; FB-2A remains at 01 Feb 2019; FB-2B moves to 01 May 2002; FB-3 moves to 22 Mar 1998; and FB-4 moves to 15 Sep 2000.
