Who Can Apply for a Marriage-Based Green Card?

You may be eligible to sponsor your spouse, husband, or wife if:

You are a U.S. citizen married to a foreign national.
Your marriage is legally valid and genuine (not solely for immigration purposes).
Your spouse entered the U.S. legally or qualifies for a waiver if they entered without inspection.
You meet financial requirements to sponsor your spouse or have a joint sponsor.
You are both at least 18 years old and legally able to marry.

The Marriage Green Card Process: Step by Step

File the I-130 Petition

This establishes the legal spousal relationship with USCIS.

Green Card Application (I-485 or Consular Processing)

  • If your spouse, husband, or wife is already in the U.S., they may file Form I-485 (Adjustment of Status).
  • If your spouse, husband, or wife is outside the U.S., they will go through Consular Processing at a U.S. Embassy or Consulate.

Attend the Interview

Both spouses may be required to attend an interview to confirm the authenticity of the marriage.

Receive the Green Card

If approved, your spouse, husband, or wife receives conditional or permanent residency, depending on the length of your marriage.

For couples married less than two years at the time of approval, a 2-year conditional green card is issued. You must jointly file to remove conditions before it expires. Couples married longer than two years receive a 10-year permanent green card. Our firm assists with every step—including filing petitions to remove conditions and preparing for the green card interview.

How Long Does the Process Take?

Processing times vary, but most cases take 12–18 months. We help streamline your application to avoid unnecessary delays. Some steps may be expedited in urgent situations, such as for military families or cases involving humanitarian factors. We’ll help determine if your situation qualifies.
