The Marriage Green Card Process: Step by Step
1.
File the I-130 Petition
This establishes the legal spousal relationship with USCIS.
2.
Green Card Application (I-485 or Consular Processing)
- If your spouse, husband, or wife is already in the U.S., they may file Form I-485 (Adjustment of Status).
- If your spouse, husband, or wife is outside the U.S., they will go through Consular Processing at a U.S. Embassy or Consulate.
3.
Attend the Interview
Both spouses may be required to attend an interview to confirm the authenticity of the marriage.
4.
Receive the Green Card
If approved, your spouse, husband, or wife receives conditional or permanent residency, depending on the length of your marriage.
For couples married less than two years at the time of approval, a 2-year conditional green card is issued. You must jointly file to remove conditions before it expires. Couples married longer than two years receive a 10-year permanent green card. Our firm assists with every step—including filing petitions to remove conditions and preparing for the green card interview.
